Terms of Use

Article 1 (Purpose)

The purpose of these Terms of Use is to stipulate the rights, obligations, and responsibilities of Deeping Source, Inc. (hereinafter referred to as the “Company”) and the User, as well as other necessary matters, in using the Internet-related services (hereinafter referred to as the “Service”) provided in the SEAL operated by the Company.

Article 2 (Definition of Terms)

The main terms used in the Terms of Use are defined as follows.

  1. Company: means a business operator that provides the Service.Service: means any service to provide Users with access to SEAL, a de-identified AI solution.
  2. Website: means the Internet website from which the Service is provided
  3. User: means an individual or company that enters into a service use contract with the Company in accordance with these Terms of Use and uses the Service provided by the Company.
  4. Service Use Contract: means a contract entered into between the Company and the User regarding the use of the Website.
  5. Operator: refers to the operator who establishes and operates a homepage on the service.

Article 3 (Rules other than Terms and Conditions)

  1. The “Company” shall post the contents of these Terms of Use, the names of the Company and its representative, the address of the business location (including the address of the place where consumer complaints can be handled), telephone number, fax number, e-mail address, business registration number, e-commerce business registration number, and personal information manager, etc. within the screen of the Service or on a separate connected screen, or provide it as a pop-up screen so that the User can easily notice it.
  2. The Company may amend or modify these Terms of Use to the extent that they do not violate relevant laws such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on Regulation of Terms and Conditions, the Basic Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-Door Sales, and the Consumer Electronic Act.
  3. If the Company amends the Terms of Use, it shall specify the date of application and the reason for the amendment and notify the amended Terms of Use in accordance with the method in Paragraph 1 from 7 days before the date of application to the day before the date of application. However, if the Terms of Use hereunder are changed to the disadvantage of the User, it shall be notified with a grace period of at least 30 days in advance. In this case, the Company shall clearly compare the contents before and after the amendment and display both of them so that the User can easily understand the difference.
  4. If the Company amends the Terms of Use, the amended Terms and Conditions shall apply only to contracts concluded after the application date, and the Terms of Use before the amendment shall apply to contracts already concluded before such application date. However, if the User who has already concluded a contract notifies the Company his or her intention to be subject to the amended Terms of Use within the grace period under the Paragraph 4 above and obtains the consent of the Company, the amended Terms and Conditions shall apply to such contract.
  5. Any matters not set forth in these Terms of Use and any interpretation hereto shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, etc. set by the Fair Trade Commission, and related laws and regulations or customs and practices.

Article 4 (Conclusion of Service Use Contract)

  1. The User agrees to these Terms by clicking the “I agree” button at the time of signing up or by using the Service.
  2. The User shall provide truthful information without any false facts to use the Service, and the Company may request additional information from the User if necessary according to the Service provided. The User who does not register his or her true information, such as stealing other people’s information or registering false information, cannot claim any rights in connection with the use of the Service, and will be punished in accordance with the relevant laws and regulations.
  3. If the Company amends the Terms of Use, it shall specify the date of application and the reason for the amendment and notify the amended Terms of Use in accordance with the method in Paragraph 1 from 7 days before the date of application to the day before the date of application. However, if the Terms of Use hereunder are changed to the disadvantage of the User, it shall be notified with a grace period of at least 30 days in advance.   4. If the Company and the User have entered into a separate agreement regarding the use of the Service, unless stipulated otherwise in such separate agreement, the terms in separate agreement shall prevail in the event of conflicts with the Terms.

Article 5 (Privacy Policy)

  1. The Website and the Operator shall follow the privacy policy of the Website. The Operator should make endeavors to protect the personal information of the User, including registered information, as stipulated by relevant laws and regulations.
  2. The personal information of the User shall be protected in accordance with the relevant laws and regulations and the Privacy Policy of the Website.
  3. However, the Operator shall not be liable for any information exposed due to reasons attributable to the User. If the User registers or distributes illegal posts such as posts that hinder public morals or threats national security, the Operator may access and view the User’s data and submit such data to the relevant authorities upon their request.

Article 6 (Operator’s Obligations)

  1. The operator shall handle opinions or complaints from Users as soon as possible if it recognizes that they are justified. However, if it is difficult to process quickly due to personal circumstances, the operator shall do its best to notify the User after the fact or send a note or e-mail to the User.
  2. In order to provide a continuous and stable Website, the operator may require the Website to repair or restore the equipment without delay when it is damaged or lost. However, if there is a natural disaster or unavoidable reason for the Website or the operator, the Website operation may be suspended.

Article 7 (User’s Obligations)

  1. Users shall comply with the matters stipulated in these Terms of Use, all regulations set by the Operator, notices, and operating policies notified on the Website, and related laws and regulations, and shall not engage in other acts that interfere with the business of the Website or damage the reputation of the Website.
  2. Users shall not engage in any of the following acts in connection with the use of the services provided by the Company.
  1. Users shall not infringe on the intellectual property rights of the Operator, the Website, and third parties.
  2. Users shall bear all civil and criminal liabilities arising from illegal acts such as sending spam or phishing content by e-mail, message, fax, or voice (hereinafter referred to as “illegal spam”) or failure to comply with relevant laws such as the Telecommunications Business Act. If the Company confirms that a User has sent illegal spam, the Company may report it to the Illegal Spam Response Center of the Korea Internet & Security Agency with relevant materials attached.
  3. The User shall not reverse engineer, analyze, or use any output of this Website for any other purpose.
  4. The rights to the results of this Website belong to the User, but the User may not provide, distribute, sell, or license them to a third party.

Article 8 (Service Hours)

  1. The Service can be used for 24 hours a day, 7 days a week, 365 days a year, unless there is a special obstacle due to business or technical reasons. However, the Website may suspend the Service on the day or time determined by the Website for regular maintenance, expansion and replacement of the system, and the suspension of the Service due to scheduled work will be announced on the homepage of the Website in advance, so please refer to it from time to time.
  2. However, the Website may temporarily or permanently suspend the Service without prior notice or announcement in the following cases.
  1. In the event of Service interruption under the preceding Paragraph, the Website will notify the User through a public announcement or notice in advance. However, if it is not possible to notify the User in advance of the suspension of the Service due to reasons beyond the control of the Website, it may be notified ex post.

Article 9 (Restrictions on Service Use)

  1. The User shall not engage in any of the following acts, and if the User engages in such acts, the Website may restrict the User’s use of the Service, take legitimate measures, terminate the Service Use Contract, or suspend the Service for a specified period of time.
  2. Any act of interfering with the use of the Website by others or stealing information
  3. Any act of impersonating the management, employees, or related parties of the Website
  4. Any act of infringing on the personal or intellectual property rights of the Website, other third parties, or interfering with their work
  5. Any act of collecting, storing, or disclosing personal information about other Users without their consent
  6. Any act that is objectively judged to be connected to a crime
  7. Any other acts that violate other relevant laws and regulations

    Article 10 (Provision of Services)

    1. The Company shall post the Services it provides to Users on its homepage.
    2. The Company may conduct regular inspections when necessary for the provision of the Services, and the time of regular inspection shall be as notified by the Company in advance.
    3. The Company may provide some or all of the Services when recognized by the Company, consultations, or demonstration services, free of charge for a certain period of time.
    4. In order to provide better services, the Company may display various information related to the use of the Service, including various notices, management messages, and other advertisements, on the Service screen or send them to the User’s e-mail (electronic mail) during the free trial service period.

      Article 11 (Responsibilities for Using the Services)

      The User is the consignor of the data provided when using the Service, and the Company is the consignee of the data provided by the User when using the Service. Each party will comply with the responsibilities applicable to the processing of data when using the Service.

      1. The User entrusts the Company with the processing of de-identification of personal information of image and video data.
        1. The User has the right to control the personal information of images and video data subject to de-identification.

        Article 12 (Change of Service)

        1. The Company may change all or part of the Services provided in accordance with the Company's policy, operational, and technical needs if there is a substantial reason, and no compensation shall be paid to the User unless otherwise provided by applicable laws.
        2. If there is a change in the content, method of use, and time of use of the service, the company shall notify the User of the reason for the change, the content of the service to be changed, and the date of provision, etc. in the manner of notification to the User in Article 9 Paragraph 3 before the change.

            Article 13 (Damages)

            1. The User shall be primarily responsible for all civil and criminal liability arising from this Website.
            2. The Company shall not compensate for any damages incurred to the User from this Website due to force majeure reasons such as natural disasters or due to the User’s willfulness or negligence.

                Article 14 (Restriction and Suspension of Service Use)

                1. The Company may restrict or suspend the use of the Service if the User violates the obligations of these Terms of Use or interferes with the normal operation of the Service.
                2. Notwithstanding the foregoing, the Company may immediately and permanently suspend the use of the Service in cases of violation of relevant laws, such as impersonation in violation of relevant laws, provision and operation of illegal programs in violation of copyright laws, illegal communication in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, hacking, distribution of malicious programs, excessive use of access rights, etc. Upon suspension of Service use pursuant to this Paragraph, all benefits and rights within the Service shall be extinguished, and the Company shall not compensate for them separately.
                3. If the Company becomes unable to provide the Service for reasons such as switching business items, abandoning the business, or integration between companies, the Company may notify the User and terminate the Service in the manner set forth in Article 9 Paragraph 3.

                    Article 15 (Indemnification)

                    1. The Operator shall be exempted from liability for any damages arising from the User’s failure to obtain the expected benefits from the provision of the Services on the Website or from the User’s selection or use of the Service materials.
                    2. The Operator shall be exempted from liability in the event of failure of the Service base of this Website or telecommunication services provided by other telecommunication companies, and shall comply with the Terms of Use of the Website for damages related to the Service base of this Website.
                    3. The Operator shall not be liable for any material stored, posted or transmitted by the User.
                    4. The Operator shall not be liable for any disruption in the use of the Service due to reasons attributable to the User.
                    5. The Operator is not responsible for any activities (including data transmission and other community activities) between Users or between Users and third parties, whether inside or outside the Service.
                    6. The Operator shall not be responsible for the contents, including the authenticity, reliability, and accuracy, of any materials posted or transmitted by the User and any materials that may be made available to the User through this Website.
                    7. The Operator shall not be liable for any damages arising from the transaction of goods between Users or between Users and third parties through the Service.
                    8. The Operator shall not be liable for any disputes between Users or between Users and third parties without any reason attributable to the Operator.

                        The Operator shall not be liable for any damage to the User caused by system failures that may occur without willful misconduct or gross negligence in the process of managing, inspecting, repairing, or replacing equipment such as servers or in the process of operating software, system failures caused by attacks by third parties, the spread of computer viruses for which countermeasures have not been developed by prominent research institutes or security-related companies at home and abroad, or other force majeure reasons beyond the Operator’s control.
